AREAS OF PRACTICE

Wills and Estates

Wills: A Will is something that most people need to have. It’s also important to think about whether a Will that you’ve had for a while needs an update, to reflect life’s changes in circumstances and sometimes relationships. We can do Wills for both people who are in any sort of relationship at a discounted rate.

Deceased Estates: We can help you handle deceased estates.  When a person dies leaving assets in Tasmania, the executor of the person’s Will usually has to deal with the assets and bills of the estate and then distribute the estate to the person entitled to it.    To do this, a grant of Probate may be needed. If a person dies without a Will or if they had a Will but the executor doesn’t want to deal with it, Letters of Administration may be needed, usually granted to the next of kin. We can assist you with all of this. We aim to minimise the stress or upset that’s often involved in dealing with the property and financial affairs of a deceased loved one.

Claims against Wills and Estates: Most Wills and estates are finalised without hassles. Not always. Sometimes a person wants to dispute a Will. They might have a concern that the person who made the Will didn’t really know what they were doing, or maybe that other people have twisted their arms when the Will was being made. Other people might think that they were not properly provided for by the deceased person in the Will. We can give you advice about any concerns like that. If needed, we can do what needs to be done to take a Will or Estate dispute to a Court. We can act as your Lawyers in making or opposing a claim on a Will or deceased estate.

Family Law

Family Law: We can advise you about property issues that have been agreed on if your relationship ends and help you with getting a proper Financial Agreement in place. Some people want the extra comfort of having an agreement that sets out what is to happen if the relationship doesn’t last, before they start doing things like buying property together. We can help with that too.

Powers of Attorney

A Power of Attorney is a legal document that appoints a person ("attorney") to make decisions on your behalf about things that relate to your financial and legal affairs, like accessing funds in your bank accounts and paying bills, and also selling or purchasing property. It does not allow a person to make decisions about your medical or personal affairs - this can be done by appointing an enduring guardian or using a Care Directive.

Life can be unpredictable. Having a Power of Attorney in place ensures that your financial and legal decisions are handled by someone you trust - when it matters most. We can help you create a Power of Attorney that reflects your wishes and protects your interests. Whether you're planning ahead for the future or you need urgent assistance, we are here to help.

AREAS OF PRACTICE

Solicitor's Certificates for Bank Loans and Security / Guarantees

Solicitor's Bank guarantees are often needed when getting finance to buy property, for example maybe when helping your children get a home loan ("the bank of mum and dad"). While these arrangements can be popular, they do come with significant risks. A lender might want to ensure that any guarantor is aware of the implications of the documents they are signing and, for proof of that, a Lender will often require a Solicitors' Certificate.

We can provide fixed-price Solicitors' Certificates for bank guarantees, ensuring a quick and straightforward process at a competitive cost. We will explain the terms of the loan documents and what it may mean to you as a guarantor.
